Electrical safety law has changed significantly. New regulations now bring social housing landlords under the same mandatory inspection regime that private landlords have operated under since 2020 — and the deadlines are already in force.
The Social Housing (Regulation) Act 2023 and accompanying guidance has extended the requirement for five-yearly Electrical Installation Condition Reports (EICRs) to registered providers of social housing in England. This closes a long-standing gap in the law — private sector landlords have been required to carry out EICRs since 2020, but social housing providers were previously not subject to the same mandatory regime.
The new rules apply to registered providers of social housing — this includes local councils, housing associations and other registered providers with residential tenancies in England. If you manage a portfolio of social housing properties in Kent, you need to ensure every property has a valid EICR in place.
An EICR must be carried out at least every five years, or at every change of tenancy — whichever comes sooner.
The government has staggered rollout, but the deadlines are now in force. If you haven't already started reviewing your portfolio for compliance, you need to act now. Failure to comply can result in remedial notices, financial penalties, and reputational damage.
An EICR is a detailed inspection of a property's fixed electrical installation — consumer unit, wiring, sockets, switches, light fittings and earthing. The inspection is carried out by a qualified electrician and produces a report graded C1 (danger present), C2 (potential danger), C3 (improvement recommended) or FI (further investigation required).
Any C1 or C2 observations must be remedied within 28 days of the report being issued.
